US Agent for Service of Process Update

The FCC has recently updated KDB 986446, expanding the responsibilities that Telecommunications Certification Bodies (TCBs) have when validating the US Agent for Service of Process (“US Agent”). These policy changes affect how applications are processed and how contact information must be provided moving forward.

Here are the highlights:

  1. The Non-Technical Contact section on FCC Form 731 is now reserved exclusively for US Agent information. Organizations that need additional contact points should ensure their “Technical Contact” details utilize a shared email address.
  2. If the listed US Agent information does not match the authorized individual (person named in the grantee code), then an updated US Agent attestation will be required.
  3. The designated US Agent must be someone who can reasonably be expected to be physically present at the provided address.
  4. The listed US Agent must have a physical address. PO boxes, vacant lots, mail forwarders, etc. are not valid.
  5. CKCCS’s revised US Agent attestation template includes the necessary details meeting new FCC policy.
  6. Applicants serving as their own US Agent should expect to submit a revised US Agent attestation form during the next certification application.
